These Terms of Service ("Terms") govern your access to and use of the website located at elevationmensclinic.com (the "Site"), and the medical, membership, and related services offered by Brazell & Associates, Inc. d/b/a Elevation Men's Clinic ("Elevation," "we," "us," or "our"), located at 100 Brampton Ave., STE 2D, Statesboro, GA 30458. By accessing the Site, creating an account, enrolling in a membership, or receiving services from Elevation, you ("you," "patient," or "member") agree to be bound by these Terms. If you do not agree, do not use the Site or our services.


1. Overview of Services

Elevation Men's Clinic is a men's health practice providing in-person medical evaluation, laboratory testing, provider oversight, and treatment services, including hormone therapy, sexual wellness treatments, and related men's health services. Services are provided under the supervision of licensed medical providers.

Certain treatments involve compounded medications prepared by third-party licensed 503A compounding pharmacies (currently including Empower Pharmacy and RUSH Pharmacy). These pharmacies are independent entities responsible for the preparation, dispensing, and shipment of your medication in accordance with your provider's prescription. Elevation does not compound, manufacture, or directly dispense these medications.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract to use our services. Services are available only to individuals located in states where Elevation and its affiliated pharmacies are licensed and authorized to provide care. By enrolling, you represent that the information you provide is accurate and that you meet these eligibility requirements.

3. Medical Disclaimer

Elevation provides individualized medical care based on clinical evaluation, but no outcome is guaranteed. Information on the Site, including educational content, newsletters, and social media, is for general informational purposes only and does not constitute medical advice, nor does it establish a provider-patient relationship. A provider-patient relationship is established only after you complete an intake evaluation and are accepted as a patient.

This Site and our services are not intended for medical emergencies. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately.

Treatment recommendations, including compounded medications, are made at the sole clinical discretion of your provider based on your evaluation, labs, and medical history. Compounded medications are not FDA-approved in the same manner as commercially manufactured drugs; your provider will discuss relevant risks and alternatives with you as part of informed consent.

4. Membership Program

Elevation offers a bundled membership model that may include in-person visits, laboratory testing, provider oversight, and access to compounded treatments, depending on the membership tier you select.

- Billing. Memberships are billed on a recurring basis (monthly or as otherwise specified at enrollment) through our payment processor, Stripe. By enrolling, you authorize Elevation to charge your payment method on file for all membership fees, treatment costs, and any other charges you incur.
- Price Changes. We may modify membership pricing with reasonable advance notice. Continued use of the membership after a price change takes effect constitutes acceptance of the new pricing.
- Cancellation. You may cancel your membership at any time by submitting a written request to info@elevationmenscliic.com or through your patient portal. 30 day notice is required for cancellation of recurring monthly memberships.
- Refunds. Refunds are governed by our separate Refund and Cancellation Polic which is incorporated into these Terms by reference. Because compounded medications are prepared specifically for you upon prescription, medication costs are generally non-refundable once a pharmacy order has been placed, except as required by law or as otherwise stated in that policy.
- Non-Transferable. Memberships are personal to you and may not be transferred, shared, or resold.

5. Compounded Medications and Third-Party Pharmacies

When your provider prescribes a compounded medication, that prescription is sent to a licensed 503A compounding pharmacy of the provider's selection. You acknowledge and agree that:

- The compounding pharmacy, not Elevation, is responsible for preparing, labeling, packaging, and shipping your medication in compliance with applicable pharmacy law;
- Shipping timelines, packaging, and delivery are subject to the pharmacy's own policies and are outside Elevation's direct control;
- You are responsible for storing and using medications as instructed by your provider and the pharmacy;
- Any product-specific complaint (e.g., damaged shipment, packaging defect) should be reported to Elevation and, where applicable, the dispensing pharmacy, as soon as possible.

6. Payment Terms

All payments are processed securely through Stripe. Elevation does not store your full payment card information on its own servers. By providing a payment method, you represent that you are authorized to use it. You are responsible for keeping your billing information current. Failed or declined payments may result in a pause or termination of services until payment is resolved.

7. Patient Responsibilities

You agree to:

- Provide complete, accurate, and truthful information about your medical history, symptoms, and current medications;
- Attend scheduled appointments and complete required labs and follow-up visits as directed by your provider;
- Use prescribed medications only as directed and only for yourself;
- Notify Elevation promptly of any adverse reaction, side effect, or change in your health status;
- Not resell, share, or distribute any medication or treatment obtained through Elevation.

Failure to comply with these responsibilities may result in suspension or termination of your membership and care at Elevation's discretion, at any time and without prior notice if warranted by patient safety concerns.

8. Privacy and Health Information

Your health information is protected under the Health Insurance Portability and Accountability Act (HIPAA) and is handled in accordance with our Notice of Privacy Practices and Privacy Policy. By using our services, you consent to the collection, use, and disclosure of your health information as described in those documents.

9. Intellectual Property

All content on the Site, including text, graphics, logos, branding (including the Elevation name and marks), and educational materials, is the property of Elevation or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from Site content without our prior written consent.

10. Limitation of Liability

To the fullest extent permitted by law, Elevation and its owners, providers, and staff shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the Site or services, including damages related to third-party pharmacy performance, shipping delays, or treatment outcomes, except to the extent caused by Elevation's own negligence or willful misconduct. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for gross negligence or willful misconduct in the provision of medical care.

11. Assumption of Risk and Informed Consent

Medical treatment, including hormone therapy and use of compounded medications, carries inherent risks that will be discussed with you during your clinical evaluation and documented through separate informed consent forms specific to each treatment. Your agreement to these Terms does not replace or substitute for treatment-specific informed consent, which you will review and sign separately before beginning any treatment.

12. Termination

Elevation reserves the right to suspend or terminate your access to the Site, your membership, or your care at Elevation for any reason, including violation of these Terms, safety concerns, non-payment, or provider determination that continued treatment is not clinically appropriate. You may terminate your relationship with Elevation at any time in accordance with Section 4.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or your use of Elevation's services shall be resolved in the state or federal courts located in Bulloch County, Georgia, and you consent to the jurisdiction of those courts.

14. Changes to These Terms

We may update these Terms from time to time. The "Last Updated" date at the top of this page reflects the most recent revision. Continued use of the Site or our services after changes are posted constitutes your acceptance of the revised Terms.
